Law Concerning the Improvement of Employment Management, Etc. of Part-Time Workers (Part-Time Work Law)

CHAPTER III.  MEASURES CONCERNING THE IMPROVEMENT OF EMPLOYMENT MANAGEMENT OF PART-TIME WORKERS, ETC.

Section I. Measures Concerning the Improvement of Employment Management, Etc.

Issuing Documents Concerning Working Conditions

Article 6. An employer, when he or she has employed Part-Time Workers, shall endeavor to promptly issue to said Part-Time Workers documents concerning working hours and other working conditions (except the matters to be determined by Ministry of Health, Labour and Welfare ordinance provided for in paragraph 1 of Article 15 of the Labour Standards Law [Law No. 49 of 1947]).

Procedure for Preparing Office Regulations

Article 7. In preparing or modifying office regulations concerning matters related to Part-Time Workers, employers shall endeavor to hear the views of persons who are regarded as representatives of the majority of Part-Time Workers employed at said workplace.

Guidelines

Article 8. In addition to the provisions of the preceding two articles, the Minister of Health, Labour and Welfare shall formulate the necessary guidelines for promoting appropriate and effective implementation of the measures concerned for the Improvement of Employment Management, Etc. which employers should take under the provisions of paragraph 1 of Article 3 (hereinafter in this Chapter referred to as “Guidelines”)

2. The provisions of paragraphs 3 through 5 of Article 5 shall apply mutatis mutandis to the formulation of these Guidelines, and the provisions of paragraphs 4 and 5 of the same Article shall apply mutatis mutandis to any modification of the Guidelines.

Employment Manager for Part-Time Workers

Article 9. In order to manage matters stipulated in the Guidelines and other matters concerning the Improvement of Employment Management, Etc. of Part-Time Workers, in accordance with Ministry of Health, Labour and Welfare ordinance, at an establishment where an employer has employed more Part-Time Workers than the number of Part-Time Workers prescribed by Ministry of Health, Labour and Welfare ordinance, the employer shall endeavor to appoint an employment manager for Part-Time Workers.

Collection of Reports, Advice, Guidance and Recommendations

Article 10. The Minister of Health, Labour and Welfare may, when the Minister deems it necessary to promote the Improvement of Employment Management, Etc. of Part-Time Workers, request the submission of a report from an employer employing Part-Time Workers, and provide advice, guidance or recommendations.

2. Part of the authority of the Minister of Health, Labour and Welfare provided for in the preceding paragraph may be delegated to the director of a prefectural Labour Bureau pursuant to Ministry of Health, Labour and Welfare ordinance.

Section II. Measures Concerning Human Resources Development and Improvement, Etc.

Implementation of Vocational Training, Etc.

Article 11. In order to promote human resources development and improvement for Part-Time Workers and persons intending to become Part-Time Workers, the State, prefectures and the Employment Promotion Projects Corporation shall endeavor to pay due consideration concerning the implementation of vocational training and carry out promotional activities concerning human resources development and improvement for Part-Time Workers, persons intending to become Part-Time Workers, and other related persons.

Provision of Complete Employment Services, Etc.

Article 12. In order to make it easier for a person intending to become a Part-Time Worker to select an occupation according to his or her vocational aptitude, ability, experience and skill level, etc. and to facilitate adaptation to the occupation, the State shall endeavor to provide necessary measures to offer employment information, and to improve vocational guidance and employment services.
