Guidelines Concerning the Limitation of Night Work Provided for in Articles 16-2 and 16-3 of the Law Concerning the Welfare of Workers Who Take Care of Children or Other Family Members Including Child Care and Family Care Leave

1. Introduction

These guidelines determine matters to which employers should give consideration concerning the limitation of night work provided for in Articles 16-2 and 16-3 of the Law Concerning the Welfare of Workers Who Take Care of Children or Other Family Members Including Child Care and Family Care Leave (Law No. 76 of 1991).

2. Matters to Which Employers Should Give Consideration Concerning Limitation of Night Work

  (1) The limitation of night work shall be such that consideration is given in advance to determining matters concerning the treatment of workers during limitation of night work (including whether or not they will be reassigned to daytime work) and to taking measures to make these matters widely known to workers.
  (2) The limitation of night work shall be such that consideration is given to enabling workers to utilize the system flexibly in response to the varied situations in which said workers take care of children or family members, said workers' varied working situations, and similar circumstances.
  (3) The limitation of night work shall be such that a worker shall not be dismissed or otherwise treated disadvantageously by reason of said worker's having requested or received limitation of night work.

The Japan Institute of Workers' Evolution

The Japan Institute of Workers' Evolution was established at the time of the Equal Employment Opportunity Law's entry into force in April 1986, bringing together the experience of the corporate sector and the knowledge of experts to form a nucleus for voluntary corporate efforts aligned with national policies. With the aim of establishing good corporate employment relations, the Institute conducts a variety of programs including seminars, consultations, research, information services, and provision of subsidies and grants. These programs are designed to create a workplace environment in which women workers can fully realize their abilities, to support the harmonization of work and domestic life for workers who are taking care of a child or other family member, and to improve the employment management of part-time workers.
